4. No Guarantee of Outcome

Citizenship Italia makes no representation, warranty, or guarantee that any application, petition, or legal proceeding undertaken as part of our services will be successful. Outcomes depend on factors entirely outside our control, including but not limited to: the completeness and accuracy of genealogical records, decisions of Italian consulates or courts, changes in Italian law or administrative policy, and the conduct of third parties including government bodies and archives.

Any timelines or processing estimates we provide are good-faith estimates only and do not constitute commitments. We will not be liable for delays caused by consulates, courts, municipalities, archives, or other third parties.

5. Client Eligibility & Responsibility

It is your responsibility to provide accurate, complete, and truthful information about yourself and your ancestry at all times. You represent and warrant that:

  • All documents and information you provide to us are genuine and accurate to the best of your knowledge.
  • You have the legal right to retain our services and are not subject to any impediment that would prevent you from pursuing Italian citizenship.
  • You will promptly notify us of any material change to your circumstances or any information previously provided.

If any information you provide is found to be false, incomplete, or misleading — intentionally or otherwise — Citizenship Italia reserves the right to terminate services immediately without refund, and you may be held responsible for any resulting costs, penalties, or legal consequences.

6. Fees & Payment

All fees for our services are set out in the applicable service agreement or as quoted to you in writing. Fees are quoted in Canadian dollars (CAD) unless otherwise stated. Payment terms are as specified in your service agreement. All fees are exclusive of applicable taxes, government filing fees, court costs, translation fees, and any third-party charges, which remain your responsibility unless expressly included in writing.

Invoices are due upon receipt unless otherwise agreed in writing. We reserve the right to suspend work on your file in the event of non-payment.

7. Cancellations & Refunds

Cancellation and refund terms are governed by your individual service agreement. As a general policy:

  • Fees paid for completed work or disbursements already incurred are non-refundable.
  • Cancellations made before substantive work has begun may be eligible for a partial refund at our discretion, less any administrative costs.
  • Consultation fees are non-refundable once the consultation has taken place.

We reserve the right to terminate an engagement at any time for cause (including client non-cooperation, misrepresentation, or non-payment), in which case fees for work completed to the date of termination are non-refundable.

8. Intellectual Property

Any materials, templates, or guides we create specifically for your file remain the intellectual property of Citizenship Italia until full payment is received, at which point a limited licence to use those materials for the purpose of your citizenship application is granted.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Citizenship Italia, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of our Website or services, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or related to our services shall not exceed the total fees paid by you to Citizenship Italia in the six (6) months preceding the claim. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded or limited by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Citizenship Italia and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of our Website or services; (b) your breach of these Terms; (c) any false, inaccurate, or misleading information you provide to us; or (d) your violation of any applicable law or the rights of any third party.
